These Terms govern your use of the Fark Golf website and any purchase of goods or tour services from Fark Golf Pty Ltd (ABN [to be added]). By placing an order or booking a tour you agree to these Terms.
1. Orders & pricing
All prices are in Australian dollars (AUD) and include GST where applicable. Prices and product availability may change without notice. Your order is accepted only when we send you an order confirmation email. We may decline an order at our discretion (including for suspected fraud, pricing errors, or stock issues) and will refund any payment taken.
2. Tour bookings
Tour bookings are subject to a separate Tour Booking Agreement issued at the time of booking, which includes deposit, payment schedule, change, and cancellation terms. A 20% non-refundable deposit is required to secure a booking; the balance is due 90 days before departure. Cancellations within 60 days of departure forfeit 100% of the booking. Travel insurance covering trip cancellation and medical events is mandatory for all tour travellers.
3. Delivery & risk
Risk in physical goods passes to you when the carrier hands them over at the delivery address. See our Shipping Policy for delivery times, costs, and tracking.
4. Returns & consumer rights
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure, and to compensation for any other reasonably foreseeable loss or damage. See our Returns Policy for details.
5. Limitation of liability
To the maximum extent permitted by law, Fark Golf’s liability for any breach is limited, at our option, to (a) replacement of the goods or services, or (b) the cost of supplying equivalent goods or services. We exclude liability for indirect, consequential, or special loss.
6. Intellectual property
All content on this site — logos, photography, copy, code — is owned by Fark Golf or used under licence. You may not reproduce it for commercial purposes without written consent.
7. Governing law
These Terms are governed by the laws of New South Wales, Australia. Any dispute will be heard in the courts of New South Wales.
